These Terms of Service (“Terms”) govern your use of the Herb Whisperer website (herb-whisperer.com), the East West School of Herbalism, the Herb Whisperer shop, the digital library, community forums, and all related services (collectively, the “Services”) operated by Herb Whisperer, Inc. (“Herb Whisperer,” “we,” “us,” or “our”).
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
1. Accounts
To access certain features — including courses, the digital library, forums, and restricted shop products — you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary.
We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or are used for unauthorized purposes.
2. Course Enrollment and Access
Course enrollment through the East West School of Herbalism grants you a personal, non-transferable license to access the enrolled course content for the duration specified at the time of purchase.
Access tiers: Your enrollment determines your membership tier (Home Herbalist or Professional Herbalist), which controls access to forums, the digital library, and certain shop products. Access is granted automatically upon enrollment and may be revoked if your enrollment expires or is terminated.
Course content: All course materials — including video lessons, written content, quizzes, and supplementary materials — are the intellectual property of Herb Whisperer, Inc. and its instructors. You may not copy, reproduce, distribute, record, or share course content with anyone who is not enrolled.
Progress and completion: Course progress is tracked through our learning management system. Certificates of completion are issued at the discretion of the instructor based on course requirements.
No academic credit: Courses offered through the East West School of Herbalism are for educational enrichment. They do not confer academic degrees, professional licenses, or continuing education credits unless explicitly stated.
3. Shop Purchases
Products: We sell physical products including books, seeds, live plants, herbs, and tinctures through our WooCommerce-powered shop. Certain products (herbs and tinctures) are restricted to students enrolled in the Professional Herbalist course.
Pricing and availability: All prices are listed in US dollars. We reserve the right to change prices and product availability at any time without prior notice. Prices are confirmed at checkout.
Payment: Payments are processed securely through Stripe. By making a purchase, you represent that you are authorized to use the payment method provided.
Shipping: Physical products are shipped to the address you provide at checkout. Shipping times and costs vary by destination. Live plants are subject to seasonal shipping restrictions and may not be available for shipment during certain months.
Product descriptions: We make every effort to accurately describe our products. However, we do not warrant that product descriptions, images, or other content on our site are completely accurate, reliable, or error-free.
4. Digital Library
The digital library provides access to searchable herbal texts rendered through FlowPaper. Library access is available to Professional Herbalist students and Library Members (via subscription or course enrollment).
Library content is provided for personal educational use only. You may not download, reproduce, print, or distribute library texts. Access is non-transferable and may be revoked if your membership expires or is terminated.
5. Community Forums
Our community forums (hosted at forum.herb-whisperer.com via Discourse) are available to enrolled students based on their membership tier. By participating in the forums, you agree to:
- Treat other members with respect and courtesy.
- Not post content that is defamatory, harassing, threatening, obscene, or illegal.
- Not post spam, advertisements, or promotional material unrelated to herbalism and our community.
- Not share course content, library materials, or other proprietary information.
- Not impersonate other members or misrepresent your identity.
We reserve the right to moderate, edit, or remove any forum content and to suspend or ban users who violate these guidelines. Forum access is a privilege, not a right, and may be revoked at our sole discretion.
6. Herbal Consultations
Herbal consultations with Dr. Garran are educational in nature and are not a substitute for professional medical advice, diagnosis, or treatment. Herbal recommendations are based on traditional use and the practitioner’s experience — they are not FDA-approved treatments for any condition.
By booking a consultation, you acknowledge that:
- You should consult a licensed healthcare provider for medical conditions.
- Herbal products may interact with medications. Disclose all medications and supplements to your practitioner.
- You are providing health information voluntarily and at your own discretion.
- Results are not guaranteed and vary by individual.
7. Intellectual Property
All content on our website — including text, images, photographs, videos, course materials, the botanical gallery, logos, and design elements — is the property of Herb Whisperer, Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content from our website without our prior written consent.
The Herb Whisperer name, logo, and related marks are trademarks of Herb Whisperer, Inc. The Passiflora Press name and logo are trademarks of Herb Whisperer, Inc.
8. User Content
By posting content on our forums, submitting comments on blog posts, or contributing to any community feature, you grant Herb Whisperer a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content in connection with operating our Services. You retain ownership of your content but are responsible for ensuring it does not infringe on the rights of others.
9. Health and Safety Disclaimer
The information provided on our website, in our courses, in the digital library, and during consultations is for educational purposes only. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
Herbs and herbal products can have side effects and interactions with medications. Always consult a qualified healthcare professional before using herbal remedies, especially if you are pregnant, nursing, taking medication, or have a medical condition.
Herb Whisperer, Inc. and its instructors are not liable for any adverse effects or consequences resulting from the use of any information, suggestions, or herbal preparations discussed on this website or in our courses.
10. Limitation of Liability
To the maximum extent permitted by law, Herb Whisperer, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our Services, including but not limited to loss of data, loss of profits, or personal injury.
Our total liability for any claim arising from these Terms or your use of our Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
11. Indemnification
